VACATION RENTAL AGREEMENT
STAYS BY OG

This Vacation Rental Agreement ("Agreement") is made effective as of the booking confirmation date between the following parties:

1. PARTIES
Owner: Wave Developments LLC DBA Stays By OG
Manager: OG Enterprises
Guest(s): As listed in the confirmed booking details.

2. PROPERTY
The property subject to this Agreement is the property listed in the confirmed booking details.

3. TERM OF RENTAL
The check-in date, check-out date, and times are as confirmed in the booking details.

4. NIGHTLY RATE, TAXES & FEES
The nightly rate, applicable taxes, and all other fees—including but not limited to cleaning fees and security deposits—are as stated in the confirmed booking details.

5. SECURITY DEPOSIT & DAMAGES

  • A refundable security deposit may be required, as outlined in the confirmed booking.

  • Deductions may be made for damages, missing items, or excessive cleaning fees.

  • Refunds will be processed within 10 days after check-out.

6. OCCUPANCY & USE

  • The rental is for the maximum number of guests stated in the confirmed booking.

  • No subletting or unauthorized occupants allowed.

  • The property shall be used for vacation purposes only.

7. HOUSE RULES & TERMINATION OF AGREEMENT

  • By booking this property, the guest agrees to comply with the Stays By OG House Rules:

  • Violation of any house rules, or any local, county, state, or federal laws by the guest or their invitees will result in immediate termination of this Agreement. The owner reserves the right to require the guest and all invitees to vacate the property immediately without a refund.

8. CANCELLATION POLICY
Primary Cancellation Policy:

  • 100% of paid prepayments refundable when canceled 90 days before arrival or earlier.

  • 50% of paid prepayments refundable when canceled 30 days before arrival or earlier.

  • 0% refundable if canceled after.

Payment Schedule:

  • 50% due at the time of booking.

  • Remaining balance due 7 days before arrival.

9. LIABILITY & INDEMNIFICATION

  • The owner is not responsible for lost, stolen, or damaged personal property.

  • The guest agrees to indemnify the owner from claims arising from use of the premises.

10. MAINTENANCE & DAMAGE REPORTING
The guest must report any damages immediately using the Maintenance Request Form:

11. AMENITIES, ENVIRONMENT & GUEST EXPECTATIONS
The property and all amenities are provided as-is. The property is located in a coastal environment, and sand, salt, wind, and humidity are natural and unavoidable. Guests acknowledge that minor sand or debris on patios, in spas/pools, or on beach equipment is normal and does not constitute a failure to maintain the property.

Amenities such as spas, pools, grills, beach equipment, and electronics are provided for guest enjoyment but are not guaranteed against interruption, malfunction, or personal dissatisfaction. The Owner will make reasonable efforts to repair or replace amenities if issues arise; however, remedies are limited to repair or replacement.

Subjective matters of personal comfort (such as mattress firmness, pillow style, or décor preferences) are not grounds for complaint or refund. Guests must use amenities properly and in accordance with posted rules (e.g., showering before spa use), and additional charges may apply for misuse or excessive cleaning.

12. FORCE MAJEURE
The owner is not liable for disruptions due to events beyond control (e.g., hurricanes, natural disasters).

13. NOT A LANDLORD-TENANT AGREEMENT
This Agreement is not a landlord-tenant agreement and does not create a leasehold interest or any rights under Florida’s landlord-tenant laws.
The guest is granted a temporary license to occupy the property for the agreed rental period.
The guest must vacate the property upon check-out as stated in the confirmed booking details.

14. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Florida and the County of Brevard.

15. ACCEPTANCE
By completing this booking, the guest acknowledges and agrees to all terms of this Vacation Rental Agreement and the House Rules:
